In his influential paper Legal Reasons, Sources and Gaps' reprinted in The Authority of Law (Oxford: Oxford University Press, 1979), Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the (...) claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principle of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show ‐ with the aid of a sophisticated analytical tool, i.e. von Wright's Truth Logic ‐ that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth‐values. For this reason, Raz's paper can still be regarded as a good starting‐point for analyzing the relationships among norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

Impaired emotional capacity in antisocial populations is a well-known reality. Taking the dimensional approach to the study of emotion, emotions are perceived as a disposition to action; they emerge from arousal of the appetitive or aversive system, and result in subjective, behavioral, and physiological responses that are modulated by the dimensions of valence, arousal, and dominance. This study uses the International Affective Picture System (IAPS) to study the interaction between the type of picture presented (pleasant, neutral, or unpleasant) and group (...) (adolescents under custody in juvenile justice centers, adolescents under non-custodial measures, and secondary school students) in the emotional assessment of these dimensions. The interaction between the study variables was statistically significant. Statistically significant differences were found between the three types of pictures presented, in the ratings of unpleasant pictures between the custody group and the group of secondary students in regular schooling in valence, and in the ratings of unpleasant, neutral, and pleasant pictures in arousal, between the custody group and all groups. Discriminant analyses of each affective dimension indicate that the unpleasant pictures with violent and/or aggressive content tend to be in the functions that most differentiate the antisocial groups. Firstly, citing works are studied: the numbers of published articles in the analyzed period, authors of fhese articles, and the institution of (...) the cited authors. Consecutively, citations are analyzed. Language is more than a source of information for accessing higher-order conceptual knowledge. Indeed, language may determine how people perceive and interpret visual stimuli. Visual processing in linguistic contexts, for instance, mirrors language processing and happens incrementally, rather than through variously-oriented fixations over a particular scene. The consequences of this atypical visual processing are yet to be determined. Here, we investigated the integration of visual and linguistic input during a reasoning task. Participants listened to sentences containing conjunctions or disjunctions and (...) looked at visual scenes containing two pictures that either matched or mismatched the nouns. Degree of match between nouns and pictures and between their expected and actual spatial positions affected fixations as well as judgments. We conclude that language induces incremental processing of visual scenes, which in turn becomes susceptible to reasoning errors during the language-meaning verification process. (shrink)

Rooted in a reasoned understanding of what it is to be a human being in community, Catholic social principles are accessible to a pluralistic, even secular, audience. Instead of being used separately in an ad hoc manner, these principles can be applied as a single analytical framework in examining ethical questions. The paper begins with the concept of voice and questions its different meanings, especially in educational settings, to propose a philosophical framing of people-of-young-age’s material voices. It then proposes to understand those voices as disruptive differences or opportunities to (re)think about our roles as educators and, most of all, to return to the question of what a philosophical approach to childhood might disrupt. In doing so, it outlines some ideas about “voice” as sound and materiality (Cavarero, 2005) and also about (...) “listening” as a permanent attention to what might emerge (Nancy, 2002; Davies, 2014), to then extend particular meanings of these concepts to the practice of thinking philosophically with people of different ages in the community of philosophical inquiry educational setting (Kennedy & Kennedy, 2012). It also builds on the concept of “event” by Gilles Deleuze (Deleuze, 2013), as a potential immanent within a confluence of forces, to then ask how we can foster a philosophical way of living (in) education that takes people-of-young-age’s material voices as something we cannot afford to lose. Finally, the paper proposes to frame the community of philosophical inquiry as a philosophical community of voices, in the sense of an opportunity to experience the materiality of all the voices as something that matters in the shared thought of its participants. Error related potentials, which are elicited in the EEG in response to a perceived error, have been used for error correction and adaption in the event related potential -based brain computer interfaces designed for typing. In these typing interfaces, ERP evidence is collected in response to a sequence of stimuli presented usually in the visual form and the intended user stimulus is probabilistically inferred and presented to the user as the decision. If the inferred stimulus is incorrect, ErrP is expected (...) to be elicited in the EEG. Early approaches to use ErrP in the design of typing interfaces attempt to make hard decisions on the perceived error such that the perceived error is corrected and either the sequence of stimuli are repeated to obtain further ERP evidence, or without further repetition the stimulus with the second highest probability is presented to the user as the decision of the system. Moreover, none of the existing approaches use a language model to increase the performance of typing. In this work, unlike the existing approaches, we study the potential benefits of fusing feedback related potentials, a form of ErrP, with ERP and context information in a Bayesian fashion to detect the user intent. We present experimental results based on data from 12 healthy participants using RSVP Keyboard™ to complete a copy-phrase-task. Three paradigms are compared: [P1] uses only ERP/LM Bayesian fusion; [P2] each RSVP sequence is appended with the top candidate in the alphabet according to posterior after ERP evidence fusion; corresponding FRP is then incorporated; and [P3] the top candidate is shown as a prospect to generate FRP evidence only if its posterior exceeds a threshold. Analyses indicate that ERP/LM/FRP evidence fusion during decision making yields significant speed-accuracy benefits for the user. (shrink)

An indispensable guide to the major work of one of the twentieth century's most influential thinkers.

Feature selection is a widely studied technique whose goal is to reduce the dimensionality of the problem by removing irrelevant features. It has multiple benefits, such as improved efficacy, efficiency and interpretability of almost any type of machine learning model. Feature selection techniques may be divided into three main categories, depending on the process used to remove the features known as Filter, Wrapper and Embedded. Embedded methods are usually the preferred feature selection method that efficiently obtains a selection of the (...) most relevant features of the model. However, not all models support an embedded feature selection that forces the use of a different method, reducing the efficiency and reliability of the selection. Neural networks are an example of a model that does not support embedded feature selection. As neural networks have shown to provide remarkable results in multiple scenarios such as classification and regression, sometimes in an ensemble with a model that includes an embedded feature selection, we attempt to embed a feature selection process with a general-purpose methodology. In this work, we propose a novel general-purpose layer for neural networks that removes the influence of irrelevant features. The Feature-Aware Drop Layer is included at the top of the neural network and trained during the backpropagation process without any additional parameters. Our methodology is tested with 17 datasets for classification and regression tasks, including data from different fields such as Health, Economic and Environment, among others. The results show remarkable improvements compared to three different feature selection approaches, with reliable, efficient and effective results. (shrink)

La identidad se ha constituido como una noción hegemónica y estática, sin embargo, la música de Herencia de Timbiquí consolida identidades múltiples y evidencia la hibridación racial, histórica y cultural por la que han pasado las comunidades Afro-Pacíficas desde la época de la Colonia y la esclavitud negra hasta la globalización y el conflicto armado colombiano. Estos hechos han ido transformando las identidades que originalmente traían las comunidades desde África, pues sus prácticas culturales se fueron entretejiendo con las prácticas indígenas (...) y españolas. Posteriormente, gracias a la globalización apareció un auge de los medios masivos de comunicación y la industria cultural, lo que hizo que los cantos Afro-Pacíficos comenzaran a hibridarse con ritmos populares provenientes de Norte América y Europa. Ahora bien, esta hibridación revela la ausencia de una noción de identidad purista y estática y, a la vez, evidencia los procesos de desterritorialización simbólica y física por los que han pasado las comunidades afro-Pacíficas a través de los siglos por la imposición de culturas dominantes. The expression “end of nature” has been coined by American environ-mentalist Bill McKibben is his 1989 famous book, The End of Nature. Since then, the philosophical implications of such an obituary have been explored, mainly on an ethical perspective over the environment. The conceptual end of nature is one of those implications, in the context of a post-naturalistic environmental philosophy. Our purpose is to build upon the ambiguities of “nature” and reframe some readings of the concept of “integrity” as a (...) guiding principle in the relation between human beings and the environment. Tiraillé entre (...) deux désirs contradictoires, d'une part, la fidélité au texte source, de l'autre, le désir de venir au devant de ses récepteurs, le traducteur finit par faire le deuil de l'éthique de sa profession.This article provides an analysis of Romanian translations, published in newspapers in Romania, three sequences extracted from the press conference given by Jacques Chirac on 17 February 2003, when the "mini-crisis" caused by Iraqi aligning country -Europe, including Romania, the U.S. position, in full swing. Translators same time being the authors of the editorial are inserted where these translations, fidelity to the source text is heavily undermined. Torn between two conflicting desires, on the one hand, fidelity to the source text, the other, the desire to come to the front of its receptors, the translator finally mourn the ethics of his profession. Contemporary healthcare practice has been progressively more regulated to increase efficiency, service user safety and practice quality. However, ethical issues in clinical practice that have not been implemented into regulations are undervalued by policymakers and healthcare institutions Considering the issues found by other authors, the use of a simple tool for policymakers to consider recurrent ethical issues could reduce those issues in a policy-driven clinical practice. The lack of tools to support structured ethical assessment of clinical policies was the main (...) reason to create the Clinical Policy Ethics Assessment Tool, but we realised of its possible advantages: limiting ethical dilemmas posed by policies, ensuring ethical practice by the use of policies and developing a consistent process for policymakers, institutions and healthcare professionals. Nonetheless, even if a tool can be implemented and it supports the creation of policies that reduce ethical issues, if the healthcare professionals are not aware of them they will not be implemented and the issues will continue. The book carefully details the settler- colonial ideology and logic of elimination that permeated US territorial expansion over the Northwest Territories at the end of the eighteen and the first decades of the nineteenth centuries. Seeing Red thoroughly examines the complex context of dispossession by the US colonial power, centering on Anishinaabeg communities, the “mix- race” population, and the different Indigenous people inhabiting this region. However, the book focuses on what the author names “unthinkable history,” following Michel- Rolph Trouillot’s argument that this region, and the whole continent, was conceived as an unsettled territory instead of belonging to many Indigenous peoples. Thus, the text explores Indigenous and mixed- raced communities’ political imaginaries and imagined futures to retain autonomy and territory.Author Michael John Witgen is a citizen of the Red Cliff Band of Lake Superior Ojibwe and a professor in the Department of History and the Center for the Study of Ethnicity and Race at Columbia University. His research centers on the complex relations between Indigenous people and settler colonizers in the Great Lakes and the Northwest Territories. Seeing Red expands his previous analysis of race, ethnicity, and citizenship intersections, bringing to the fore Indigenous people’s history to rethink the statemaking process in the United States.This book’s pages show that theft lies at the foundation of wealth transfer from Indigenous territories to the United States government and white citizens. The white settler ideology, based on a “doctrine of discovery,” established a stark division between the civilized and uncivilized to rationalize, among other things, the theft of Indigenous people. This is a central argument of the book that signals how the civili zation project underpinning the territorial expansion of the United States was based on the transformation of commons into private property. Indigenous land became critical in the “political economy of plunder” advanced by the state and the meaning of “native” as a racial categorization of exclusion. Chapter 1 explores this economy of plunder by detailing the advancement of the settler frontier through different [End Page 139] mechanisms, such as the treaty policy— subsequently violated by the state— and territory surveying to make land legible for the state and cheap for settlers. It is worth mentioning that the book contains historical and thematic maps that visually represent the ideology of wilderness behind the colonization project and evidence of the territorial extent of dispossession suffered by Indigenous communities. However, this crusade to dispossess Indigenous peoples from their territory also rested on the national mythology that strengthened the trope of Indigenous vanishing. The author shows how during the years of the study, the Indigenous population was not vanishing but immersed in an intricate social world and transregional trade networks. Chapter 2 explores such context, following the story of an Ojibwe man to evidence the context in which settlers and federal officials relied on Indigenous customs to profit from the fur trade while using ties with communities to further land cessions.Mix- race families played a crucial role in expanding the settler frontier through treaty negotiations but remained marginalized as they identified themselves as both Natives and US citizens. Chapter 3 examines the significance of mixed- raced families, particularly women, in establishing and expanding missions’ schools that relied on their domestic and linguistic labor. Prueba de ello es el libro Poesía-documento, titulado Antigua Luna (2017), de la escritora costarricense Magda Zavala, publicado en 2017 por la editorial Letra Maya, dentro de la Colección Kayab, en Costa Rica. Este poemario, dividido en tres secciones; I. Capital de los Confines, II. Espacios y voces y III. La visitante, recoge entre sus versos (...) los resabios coloniales de un pasado épico, que convive con un presente transnacional y postmoderno. Employing a time-lagged sample of 371 North American individuals working full time in a wide range of industries, occupations, and levels, we contribute to research on employee outcomes of corporate social responsibility attributions as substantive or symbolic. Utilizing a mediated moderation model, our study extends previous findings by explaining how and why CSR attributions are related with work-related attitudes and subsequent individual performance. In support of our hypotheses, our findings indicate that the relationships between CSR attributions and individual performance are (...) mediated through person–organization fit and work-related attitudes. Additionally, when CSR is perceived as important, substantive CSR is positively related to, and symbolic CSR is negatively related to, perception of fit with the organization. These findings contribute toward our understanding of the complex effect CSR has on employees’ work outcomes. Practical implications and future research directions are discussed. (shrink)

La ciencia se sustenta en la veracidad de los datos de investigación, y por ende, en la confianza sobre la integridad moral y profesional de los investigadores. Sin embargo, diversos factores ocasionan que la conducta inapropiada en la investigación sea un problema vigente. Revisamos los problemas éticos en el ensayo _Evaluation of XIENCE versus Coronary Artery Bypass Surgery for Effectiveness of Left Main Revascularization_ (EXCEL), que comparó el intervencionismo coronario percutáneo frente a la cirugía de revascularización en la enfermedad del (...) tronco coronario izquierdo con un SYNTAX score ≤32. Preocupaciones sobre la metodología, actividades asociadas a la veracidad de los datos, y conducta inapropiada durante la investigación son advertidas en este estudio de caso. Se concluye sobre la necesidad de revisar y reconsiderar la vigencia e importancia de los aspectos bioéticos en la investigación clínica, aspectos que no pueden soslayarse. (shrink)

The present study discusses findings that replicate and extend the original work of Burns and Vollmeyer (2002), which showed that performance in problem solving tasks was more accurate when people were engaged in a non-specific goal than in a specific goal. The main innovation here was to examine the goal specificity effect under both observation-based and conventional action-based learning conditions. The findings show that goal specificity affects the accuracy of problem solving in the same way, both when the learning stage (...) of the task is observationbased and when it is action-based. Additionally, the findings show that, when instructions do not promote goal specificity, observation-based problem solving is as effective as action-based problem solving. (shrink)
